Welcome! This site provides information about a settlement of the Cerdes v. Cummins class action lawsuit. The links provide notices approved by the Court concerning the case, a settlement claim form, additional court documents and information, and some important deadlines.

| Not yet set | The last day to file a claim for installation of a drain hole or valve (see the Claim Form) will be six months after the Effective Date of the settlement. The Effective Date is six months after the date on which any Final Judgment approving the settlement is no longer subject to judicial review or appeal. This means the last day to file a claim will be more than six months after July 22, 2009. |
| Not yet set | The last day to file a claim for reimbursement for a prior installation of a drain hole or valve or a prior inspection and repair (see the Claim Form) will be six months after the Effective Date of the settlement. The Effective Date is six months after the date on which any Final Judgment approving the settlement is no longer subject to judicial review or appeal. This means the last day to file a claim will be more than six months after July 22, 2009. You may want to review the limiting conditions for such claims carefully before submitting any form. |
If you have a commercial engine that qualifies under this settlement, here is a link to the basic terms from the Settlement Agreement that will be included in a limited extended warranty that may apply to that commercial engine. For more information, please see the longer version of the Settlement Notice on this website. Prior to or upon approval of the Settlement Agreement, Cummins will post a separate, more detailed limited extended warranty document including customary disclaimers and other features to conform the limited extended warranty to standard Cummins practice. The specific terms from the Settlement Agreement will incorporated in that document.
